Overview

THE 2011 HOPE INSTITUTE DREAM HOUSE RAFFLE
OFFICIAL RULES AND REGULATIONS

The 2011 Hope Institute Dream House Raffle (“Raffle”) is being conducted by The Hope Institute for Children and Families (“THI”), a not-for-profit charitable organization. The Raffle is being conducted pursuant to the Illinois Raffles Act, 230 ILCS 15/0.01 et seq., and the Sangamon County Code, Chapter 5.18 of Title 5, to raise funds for ongoing charitable purposes. The 2011 Hope Institute Dream House Raffle Official Rules and Regulations (the “Official Rules”) are set forth below. By purchasing a Raffle ticket (a “Ticket”), the purchaser acknowledges that he or she is aware of, and agrees to be bound by, these Official Rules and THI’s interpretation of any such Official Rules. THI shall be responsible for interpreting and applying the Official Rules. THI’s interpretation and application of such rules shall be final.

Eligibility: Any individual who is 18 years of age or older at the time of the purchase of the Ticket is eligible to enter the Raffle. THI’s employees, officers, members of its Board of Directors and their respective spouses and children living in the same household are excluded from participating in the Raffle and are ineligible to win a prize. All federal, state, and local laws and regulations apply. The Raffle is void where prohibited by law.

How to Enter: Tickets are $150.00 each. Only one (1) eligible person may be entered in the Raffle per Ticket sold. If the name of more than one (1) person is provided on a Ticket entry form and that Ticket is selected as a winning ticket, then the person named first will be deemed as the holder of record of that Ticket and declared the winner. The division of any prize among a group of persons purchasing a Ticket in common shall be to the sole responsibility of the person named as the holder of record of that Ticket should that Ticket be selected as a winner. THI is not responsible for resolving any disputes that may arise from different individuals listed on a winning Ticket.

Only 35,000 Tickets will be sold. Tickets will not be sold after January 20, 2012. Tickets may sell out before that time. An individual can purchase as many Tickets as he or she may wish, subject to availability.

  • By the Internet. Visit www.chicagoraffle.com and click on “purchase tickets.” Follow the instructions to complete the order form and submit payment.
  • By Fax. Visit www.chicagoraffle.com to obtain an order form, complete the form, print the completed form and fax the completed form to (312-254-5014).
  • By Mail. Visit www.chicagoraffle.com to obtain an order form, complete the form, print the completed form and mail the completed form to The Hope Institute, 15 East Hazel Dell Lane, Springfield, IL 62712.
  • By Telephone. Call 800-697-7734 and provide the information requested by the representative.
  • By Personal Delivery. Visit www.chicagoraffle.com to obtain an order form, complete the form, print the completed form and deliver the completed form to The Hope Institute at 15 East Hazel Dell Lane, Springfield, IL 62712.

All entries must include payment by check, money order, cash or credit card. THI reserves the right to reject any entry form that is submitted without proper payment or payment that does not constitute “good funds.” No refunds will be made except under the following circumstances: any ticket order with payment received after (1) 35,000 Tickets have been sold, or (2) January 20, 2012, will be returned. No other refunds are available except in the exclusive discretion of THI.

Upon receipt and acceptance by THI of a proper entry form, a receipt (ticket stub) of purchase will be mailed via U.S. mail to the purchaser at the billing address provided by the purchaser during the Ticket purchase. It is the purchaser’s responsibility to provide a valid, deliverable mailing address to THI.

Any defective or physically altered entry form, or entry form received without proper or sufficient payment, will be immediately disqualified by THI. Prior to the Grand Prize Drawing, THI may make a reasonable effort to notify the individual of a rejected or disqualified entry by attempting to make contact through the information provided at the time of the Ticket purchase request. Neither THI nor its directors, officers, employees, agents or other representatives assumes any responsibility or liability for lost, late, misdirected, mutilated, incomplete, illegible or undelivered entries, or any other failure to receive entries, or any failure to deliver a receipt of purchase prior to the drawing deadlines.

Prize Drawings: Prize drawings will be conducted by a representative of THI under the supervision of an independent raffle auditor. All drawings are open to the public. Entrants need not be present to win. Winners will be selected at random. For each drawing, prizes with the lowest retail value will be drawn for first progressing in order to the highest retail value prize for the drawing.

Early Bird Drawings. Early Ticket purchases may be included in up to four (4) drawings (three (3) Early Bird Drawings and the Grand Prize Drawing) depending upon when the Ticket is purchased. All such Tickets, including all winning Tickets from Early Bird Drawings will be included in the applicable subsequent Early Bird Drawings as well as the Grand Prize Drawing.

Key dates for the Early Bird Drawings are as follows:

  • Early Bird Drawing 1. Early Bird Drawing 1 will be held on or about October 18, 2011. To be eligible for this drawing, the entry must be received by 11:59 p.m. CST on September 30, 2011.
  • Early Bird Drawing 2. Early Bird Drawing 2 will be held on November 15, 2011. To be eligible for this drawing, the entry must be received by 11:59 p.m. CST on October 28, 2011.
  • Early Bird Drawing 3. Early Bird Drawing 3 will be held on December 6, 2011. To be eligible for this drawing, the entry must be received by 11:59 p.m. CST on November 18, 2011.

Grand Prize Drawing. The Grand Prize Drawing will be held on February 4, 2012. To be eligible for this drawing, the entry must be received by 11:59 p.m. CST on January 20, 2012. At the option of THI, the drawing date for the Grand Prize may take place earlier if all Tickets have been sold. All Tickets that win a lesser prize in the Grand Prize Drawing will be put back into the drum and be eligible for a chance to win the Grand Prize.

Multi-Ticket Drawing. Any individual who buys more than one Ticket will receive an entry into the Multi-Ticket Drawing for each Ticket purchased. For example, if an individual purchases two Tickets, that individual will receive two entries into the Multi-Ticket Drawing. If an individual purchases three Tickets, that individual will receive three entries into the Multi-Ticket Drawing and so on. To be eligible for this drawing, the entry must be received by 11:59 p.m. CST on January 20, 2012. The Multi-Ticket Drawing will be held at the same time as the Grand Prize Drawing.

Refer-A-Friend Drawing. For each individual who purchases a Ticket and, at the time of purchase, provides the name of the person who referred them to the Raffle (the “Referring Party”), the Referring Party will receive one entry into the Refer-A-Friend Drawing. To be eligible for this drawing, the entry must be received by 11:59 p.m. CST on January 20, 2012. The Refer-A-Friend Drawing will be held at the same time as the Grand Prize Drawing.

All orders for Tickets must be received and/or purchased by the indicated deadline to be eligible for the applicable drawing. THI assumes no responsibility for lost, late, misdirected or non-delivered mail or fax messages, or any other failure to receive orders or deliver receipts prior to the drawing deadlines.

Prizes: Subject to the terms and conditions of these Official Rules, prizes are as follows:

  • Early Bird Drawing 1:
    • First Prize: $25,000 cash
    • Second Prize: $10,000 cash
    • Third Prize: $5,000 cash
  • Early Bird Drawing 2:
    • First Prize: $25,000 cash
    • Second Prize: $10,000 cash
    • Third Prize: $5,000 cash
    • Fourth Prize: $2,500 cash
    • Fifth Prize: $1,000 cash
  • Early Bird Drawing 3:
    • First Prize: $15,000 cash
    • Second Prize: $10,000 cash
    • Third Prize: $1,000 cash
    • Fourth Prize: $1,000 cash
    • Fifth Prize: $1,000 cash
  • Grand Prize Drawing:
    • Grand Prize*: Dream House or $1,000,000 annuity or $700,000 onetime cash option.*
    • Second Prize: $25,000 cash
    • Third Prize: $10,000 cash
    • Fourth Prize: $5,000 cash
    • Fifth Prize: $2,000 cash
    • Sixth Prize - Tenth Prize: $1,000 cash each
    • Prizes 11-15: $500 each
    • Prizes 16-350: $150 each
    • * Assumes a minimum of 30,000 tickets are sold by 11:59 p.m. CST on January 20, 2012. If less than 30,000 tickets are sold, then the Grand Prize will be reduced as described below.
  • Multi-Ticket Drawing
    • First Prize: 2012 Porsche Boxster or $30,000 cash
    • Second Prize: European Vacation or $10,000 cash
    • Third Prize: Hawaiian Vacation or $5,000 cash
  • Refer-A-Friend Drawing
    • Prize: $10,000 cash

Assuming a minimum of 30,000 Tickets are sold by 11:59 p.m. CST on January 20, 2012, the winner of the Grand Prize may elect to receive: (1) the Dream House located in Hinsdale, Illinois and referred to in all Raffle materials (the “Dream House”); or (2) a $1,000,000 annuity, payable in 20 equal annual payments of $50,000 each (the “Annuity”); or (3) a one-time, lump sum payment of $700,000 (the “Cash Payment”). The Grand Prize winner must provide THI with written notice of his/her selection of the Dream House, the Annuity or the Cash Payment on or before 5:00 p.m. CST on February 29, 2012. If no notice is received by THI by then, the Grand Prize winner will automatically receive the Cash Payment as full satisfaction of the Grand Prize. If fewer than 30,000 Tickets are sold by 11:59 p.m. CST on January 20, 2012, the Raffle will be held as scheduled, and prizes will be awarded as advertised, except that the Grand Prize winner will receive a cash payment equal to 50% of the total Ticket proceeds received by THI minus all costs and expenses paid or incurred by THI in connection with the Raffle, not to exceed $700,000, as full satisfaction of the Grand Prize. For example, if only 20,000 Tickets are sold, producing a net amount of $1,000,000, after all costs and expenses related to the Raffle are paid by THI, then the Grand Prize winner would receive 50% of $1,000,000 or $500,000. The above is only an example. The actual amount of Raffle expenses and net revenue may vary.

Winners of the Multi-Ticket Drawing must provide THI with written notice of his/her selection to receive the applicable non-cash or cash prize on or before 5:00 p.m. CST on February 29, 2012. If no notice is received by THI by then, the Multi-Ticket winner for which no notice is received will automatically receive the cash prize as full satisfaction of the applicable Multi-Ticket Drawing prize.

The Dream House, if selected, will be transferred to the Grand Prize winner “AS IS, WHERE IS, AND WITH ALL FAULTS”. THI DOES NOT PROVIDE ANY GUARANTEE OR WARRANTY, EXPRESSED OR IMPLIED, IN CONNECTION WITH THE DREAM HOUSE AND ACCEPTS NO LIABILITY OR RESPONSIBILITY REGARDING THE CONSTRUCTION OR CONDITION OF THE DREAM HOUSE. THI DOES NOT WARRANT THAT THE DREAM HOUSE IS OF MERCHANTABLE QUALITY OR THAT IT CAN BE USED FOR ANY PARTICULAR PURPOSE. NO EXPRESS WARRANTIES ARE GIVEN AND NO AFFIRMATION OF THI BY WORDS AND/OR ACTIONS WILL CONSTITUTE A WARRANTY. If the Dream House is chosen as the prize, the Grand Prize winner assumes all fees, local, state and federal taxes (including, but not limited to, income taxes based on the value of the Dream House) and financing costs (including, but not limited to, closing costs, title insurance, and transfer tax and fees) which must be paid when the Dream House is transferred to the Grand Prize winner. THI makes no guarantee that the Grand Prize winner will be able to sell the Dream House for the value of the cash grand prize alternatives, nor is there any guarantee that the Internal Revenue Service (IRS) will accept that value of the Dream House for the purpose of determining any income tax that may be due from the Grand Prize winner.

All non-cash prizes may not be exactly as shown, are based on manufacturer availability and may be substituted with a prize of similar value. Any vehicle awarded as a prize comes base-model factory equipped and winner(s) are solely responsible for any and all state or local license, title, registration, taxes or fees associated with the vehicle as well as insurance (proof of which must be shown prior to delivery) and pickup or delivery costs at the dealership as well as any non-standard options chosen by the winner and negotiated with the dealership. All vehicles are subject to availability at the automobile dealer selected by THI and may be substituted for a comparable vehicle by THI. All vehicle prizes are delivered F.O.B Springfield, Illinois.

Vacation and travel prizes are for two economy class round trip airfare to the destination city and for one double occupancy standard hotel room for six nights in the destination city. All vacation and travel prizes are subject to space and availability. All gratuities, taxes and fees are the responsibility of the winner. Winners of travel related prizes must comply with all applicable requirements and restrictions related to said prizes including without limitation applicable travel dates, travel documentation and reservation and confirmation procedures.

Notification of Winners: Winners will be notified according to the contact information provided to THI at the time of Ticket purchase. If the Grand Prize, or any Multi-Ticket Drawing winner cannot be located by 5:00 p.m. on February 11, 2012, after reasonable attempts to make contact through the information provided at the time of purchasing the Ticket, such winner will be deemed to have elected the cash alternate prize and another winner will not be selected for such prize. If a selected winner is unable to be contacted or located after a period of four (4) months from the draw date of the applicable raffle drawing, the prize or its cash equivalent will be deemed to have been donated to THI.

In order to collect a prize, a winner must sign and deliver to THI: (a) a sworn affidavit of eligibility in accordance with these Official Rules and applicable law, including, without limitation, proof of age; (b) such written information as is required by any applicable tax and/or real estate laws, including, without limitation, his/her Social Security Number; (c) proof of identity in forms satisfactory to the THI showing that the person claiming the prize is the same person who is named on the winning Ticket; and (d) the winning Ticket stub. Winners of prizes of $1,000 or more may be required to submit a W-2G, Form 5754 or similar tax form (provided by THI) for tax withholding purposes.

A list of winners will be posted on the Raffle website within one week of the applicable drawing. A copy of the winners’ list and of these Official Rules may be obtained by sending a self-addressed, stamped envelope to: The Hope Institute Dream House Raffle, 15 East Hazel Dell Lane, Springfield, IL 62712. Requests must be received within 30 days of the close of the Raffle.

Winning Odds: The odds of winning a prize will depend on the number of tickets sold. If all 35,000 tickets are sold the odds of winning the Grand Prize is 1 in 35,000.

Non-Deductibility of Ticket Purchase: The IRS has taken the position that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts, and consequently, the purchase of a Ticket does not qualify as a deductible charitable contribution.

Taxes: There may be federal, state and/or local tax consequences of winning a prize in this Raffle. Any and all taxes are the sole responsibility of the winner. Each purchaser of Tickets is advised to consult his or her own tax advisors with respect to tax liabilities that may arise from winning a prize in this Raffle. Winners of prizes of $1,000 or more may be required to submit a W-2G, Form 5754 or similar tax form (provided by THI) for tax withholding purposes. All appropriate and required federal and state taxes will be withheld by THI in accordance with federal and state law, and THI will remit the balance of the cash prizes to the winners.

Terms and Conditions: The Raffle is subject to these Official Rules. These Official Rules cannot be changed by any oral statement made by any employee, consultant or agent acting on behalf of THI. By entering this Raffle, entrants accept and agree: (1) to be bound by these Official Rules and the decisions of THI which shall be final and binding; (2) waive any right to claim ambiguity in the Raffle or these Official Rules; and (3) that THI may use the entrant’s name, photograph, likeness, statements, biographical information, voice and city and state address for promotional or advertising purposes in connection with the Raffle on a worldwide basis and in all forms of media, now or hereafter known, in perpetuity, without review, permission or further compensation, except where prohibited by law. Other rules and regulations may apply. Please contact THI if you have any questions. This Raffle is void where prohibited by law.

BY ENTERING THIS RAFFLE, EACH ENTRANT RELEASES THI, ITS DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS FROM ANY AND ALL LIABILITY FOR INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, ATTORNEY’S FEES) CAUSED BY PARTICIPATING IN THE RAFFLE OR WINNING ANY PRIZE OR RESULTING FROM ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE, AND EACH WINNER AGREES TO INDEMNIFY AND HOLD THI HARMLESS FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS AND ACTIONS OF ANY KIND ARISING FROM, IN CONNECTION WITH, OR AS A RESULT OF PARTICIPATING IN THE RAFFLE OR THE WINNER’S ACCEPTANCE OR USE OF ANY PRIZE.

A RAFFLE ENTRANT’S SOLE AND EXCLUSIVE REMEDY FOR ANY CLAIM AGAINST THI ARISING OUT OF THE SALE OF TICKETS OR THE CONDUCT OF THE RAFFLE SHALL BE LIMITED TO THE RETURN OF THE PURCHASE PRICE PAID FOR HIS OR HER TICKET(S). IN NO EVENT SHALL THI, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR REPRESENTATIVES BE LIABLE TO ANY PARTY FOR ANY LOSS OR INJURIES TO EARNINGS, PROFITS OR GOODWILL, OR FOR ANY INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY PERSON OR ENTITY WHETHER ARISING IN CONTRACT, TORT OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THE RAFFLE OR THESE OFFICIAL RULES SHALL BE SETTLED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (PURSUANT TO ITS EXPEDITED PROCEDURES) UNDER ITS COMMERCIAL ARBITRATION RULES AND CONDUCTED IN SPRINGFIELD, ILLINOIS, AND JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF.

Cancellation/Termination of Raffle: By purchasing a Ticket and choosing to participate in the Raffle, each Raffle participant acknowledges and agrees that THI has the right, in its sole discretion, to elect not to proceed with the Raffle for any reason whatsoever or for no reason, and in such event, a participant's sole and exclusive remedy shall be to receive a refund of the full price paid by such participant for each Ticket purchased, without interest.

Registration with the State of Illinois: THI has registered with the Sangamon County Clerk’s Office under Raffle License Number 2011-00201. The Raffle License Number will be published in all marketing materials where possible.
